The next question for consideration is whether the practice
of omission to which Mr. Lenfestey was habituated was known
to or tacitly acquissoed in by the Harbour Master.
It is,
on this point, your Committee thinks, not unimportant to ob-
serve that the attitudes taken up by the Harbour Master and
the Assistant Harbour Master, (Commander Beckwith) shew con-
siderable divergence. The latter, who when the Harbour
Master has been on leave has acted as Harbour laster, states
that at the time when he placed ir. Lenfestey in charge of the
Junk office he impressed upon him the necessity for keeping
a close watch on the Shroff, regarding whom there had been
rumours of malpractices; that he never had the slightest suse
picion that Mr. Lenfestey did not carry out literally the
terms of the "eneral Order by satisfying himself that the
amounts for which he signed receipts were duly entered in the
Shroff's Collection book; that he regarded I'r. Lengestey as
a trained' clerk, thoroughly familiar with his books; that he
did not give "r. Lenfestey any express order as to his duties
in respect of this Government Order not thinking it necessary
to do so but being of the opinion then and now that if lr. Len-
festey did not know that this obligation was part of his duty
he ought to have known it,
It is a little difficult how-
ever to understand Commander Beckwith's point of view that tr.
Lenfestey literally saw that the amount of each receipt which
he signed, was, before he affixed his signature, entered in
the Shroff's Collection book, seeing that the form in which
the entries in the Shroff's Collection book were made pre-
cludes this possibility; no doubt such a refinement of detail
never occurred to the Assistant Harbour laster. The Harbour
Kaster, on the other hand, states that he was aware that Er.
Lenfeatey did not literally carry out the material portion of
the Government order referred to; but he asserts that he was
always under the impression that Mr. Lenfestey personally
